Walden Macht & Haran Submits Amicus Brief in Second Circuit, Helping to Enable Manhattan District Attorney Alvin Bragg, Jr. Reach Settlement with Jim Jordan and House Judiciary Committee on Subpoena Terms Seeking Testimony from Mark Pomerantz

New York, N.Y, April 22, 2023Walden Macht & Haran represented 49 former state and federal prosecutors as amicus curiae in support of Manhattan District Attorney Alvin Bragg’s lawsuit against Rep. Jim Jordan and the Committee on the Judiciary of the U.S. House of Representatives, seeking to prevent their interference in connection with the currently pending criminal prosecution of Donald Trump. Jordan and the Judiciary Committee served a subpoena on former Special Assistant District Attorney Mark Pomerantz for his testimony at a deposition scheduled for April 19. On Friday, the parties reached a settlement under which the deposition will go forward on May 12, and DA Bragg’s general counsel will be permitted to be present during Pomerantz’s testimony. The settlement will give the District Attorney’s Office additional time to prepare for the deposition, and more importantly, a representative at the deposition to protect the interests of DA Bragg and his ongoing criminal prosecution.

Last week, on behalf of the amici, Walden Macht & Haran partner Jeffrey Udell and associate Alexander Kahn submitted amicus filings in the District Court and Second Circuit, which helped to enable DA Bragg reach a favorable settlement. In their Second Circuit brief, they argued that the actions of Jordan and the Judiciary Committee “threaten[ed] to grossly undermine the role of the prosecutor, hinder the criminal investigative and trial processes, and upend this country’s centuries-old balance of separation of powers and federalism.” Jeffrey Udell, who previously served as an Assistant United States Attorney for the Southern District of New York, stated, “We were honored to represent such an esteemed coalition of former prosecutors and grateful to share our perspective with the Court on the profound issues at stake in this case.”
